Uddannelses- og Forskningsstyrelsen er blevet opmærksom på, at vores hidtidige fortolkning af reglen er i uoverensstemmelse med EU-retten, fordi vi har lagt vægt på ansøgerens og ikke familiemedlemmets ophold i Danmark.
Du kan derfor få din sag genoptaget, hvis dit EU-/EØS-familiemedlem på ansøgningstidspunktet havde haft 5 års sammenhængende ophold i Danmark – også selvom du ikke selv havde boet i Danmark i 5 år.
På baggrund af den nye fortolkning har vi ændret praksis samt vejledningen om 5 års sammenhængende ophold her på su.dk, så den nu er i overensstemmelse med EU-retten.

You have previously received a rejection under the rule of 5 years of continuous residence
Your case may be reopened if, during the period from February 2023 to January 2026, you received a rejection of your application for equal status with Danish citizens according to the rule of being a family member of an EU, EEA, or Swiss citizen and having 5 years of continuous residence in Denmark.
We have become aware that our previous interpretation of this rule is not in accordance with EU law, as we placed emphasis on the applicant’s residence in Denmark rather than that of the family member.
You may therefore have your case reopened if your EU/EEA family member had 5 years of continuous residence in Denmark at the time of application – even if you had not lived in Denmark for 5 years.
Based on the new interpretation, we have changed our practice as well as the guidance on 5 years of continuous residence here on su.dk, so that it now complies with EU law.
